Student Visa Cancellations

 

A key issue on student visa cancellations is to keep the student enrolled and continuing to study.  Generally, permission to study on a Bridging visa E can be negotiated with DIAC, if the student is enrolled in a course.  Continuing to study has two important strategic advantages – one is that if the student continues to study and by the time there is a decision in the MRT, the student has gone a long way towards completing the course then the student has set up the ground work for a successful ministerial intervention application.

Secondly the case before the MRT has much more psychological momentum if the student appears to be a genuine student continuing to study.  It makes it easier to get credibility findings in the student’s favour.

Also having a student languishing in Australia without work or study sows the seeds for discontent or even depression.
