LEARNING OUTCOMES FOR CITIZENSHIP, RESIDENT RETURN VISAS, ABSORBED PERSONS AND ALIENS
- Identify the circumstances under which a person can apply for citizenship or dual citizenship
- Examine the residency requirements for Australian citizenship and how to apply the criteria to an individual client’s circumstances
- Recognise difficult character issues and how to assemble the evidence needed to overcome any character concerns
- Understand the criteria and exceptions for resident return visa eligibility and be able to advise clients accordingly
- Recognise when a person is a deemed ‘absorbed person’ and therefore a permanent resident
- Understand when a person is an ‘alien’, the legal consequences of such a status and how to proceed in the best interests of the client
- Understand review rights to the MRT & AAT and how to present a case before the relevant tribunal
