The Revamp of the ENS Regime Which Came into Force on 1 July 2012
Here is what paragraph 5.19(4)(h)(ii)D used to say before 1 July 2015 :
(D) the tasks to be performed in the position correspond to the tasks of an occupation at a skill level of ANZSCO skill level 1, 2 or 3;
It now says :
(D) the tasks to be performed in the position correspond to the tasks of an occupation specified by the Minister in an instrument in writing for this sub-subparagraph;
These occupations are set out in the accompanying documents being the ENSRSMS exemptions.
As one can see it includes a swag of occupations in the 4, 5 and 6 categories.
This change was made to avoid confusion as the skill level 1, 2 or 3 did not refer to the ANZSCO numbers starting with 1, 2 or 3 (as many thought).
Have a read of the accompanying document Concept of Skill Level in ANZSCO which explains all of this.
The writer has not done a trawl through the ANZSCO to see whether the new list includes all level 1 2 and 3 skill level occupations but in any event it is now restricted to those in Schedule A.
