No Visa Application Is An Island
The Hammock Principle
AT THE RISK OF MANGLING THAT GREAT POEM BY JOHN DONNE AS PART OF THE MEDITATION XVII[1], NO VISA APPLICATION IS AN ISLAND. EVERY VISA APPLICATION MUST DOVETAIL IN WITH EACH PREVIOUS VISA APPLICATION AND WITH EACH RELATED VISA APPLICATION. HERE IS AN EXAMPLE OF CARE THAT NEEDS TO BE TAKEN. A YOUNG MAN IS GRANTED A PERMANENT RESIDENCE VISA AS A SECONDARY VISA APPLICANT ON HIS PARENTS’ VISA. AFTER GRANT AND ARRIVAL IN AUSTRALIA HIS GIRLFRIEND APPLIES FOR A SPOUSE VISA. THE GIRLFRIEND WAS NEVER MENTIONED AS A SPOUSE (DE FACTO OR OTHERWISE) IN THE PREVIOUS VISA APPLICATION OF THE BOYFRIEND. IN THE SPOUSE VISA APPLICATION THE BOYFRIEND AND GIRLFRIEND GIVE A DATE FOR THE START OF THEIR RELATIONSHIP WHICH WELL PREDATES BOTH THE VISA APPLICATION AND GRANT OF THE BOYFRIEND’S PR VISA. IMMIGRATION THEN ALLEGES THAT FALSE AND MISLEADING INFORMATION WAS GIVEN IN THE EARLIER PR VISA APPLICATION AND IN THE FORM 80.
Careful planning is required in such situations and it may be good to do a chronology of both visa applications to see where there may be some disturbing overlap.
Hence in all visa applications, look to see what has been done in the past and this will have an impact on any future visa applications. Ordinarily one should have a copy of past visa applications including everything submitted (like a Form 80) and make sure there are no inconsistencies.
