What is often not understood by many migration advisers is that if a person holds a substantive visa and has been refused a visa application, the person can make a further visa application before that substantive visa expires. Sometimes it is necessary to apply for AAT AND lodge a further application.
An example is a person who had a subclass 892 business visa refused while their 160 series visa still have a few weeks to go. An application had been made to the AAT. By the time the matter was referred to the writer it was late in the afternoon of the final day of the currency of the 160 series visa. An obvious alternative strategy was applying for a subclass 457 visa using a managerial position as the occupation. This then would eventually give the person and their family access to a permanent residence visa through the ENS regime.
The 160 series was current until midnight and it was still possible to lodge the subclass 457 visa application after the 5pm deadline. Where an on-line application is not possible an application can be sent in by fax.
The corollary of this is that a visa granted on the day after a visa expires will mean the applicant was legal on that day hence will not have been illegal.
