A secondary visa is as much a visa as the visa held by the primary visa holder. The secondary visa holder therefore holds a substantive visa. That secondary visa holder can go off and apply for a separate visa in his or her own right on the basis of holding a substantive visa. Offspring of business visa holders sometimes are left vulnerable when it is not realised they can peel off and get a visa in their own right, like a student visa, 457 visa or even a skilled visa. When the primary business visa holder does not manage his or her transition to permanent residence well then the offspring secondary visa holders can apply for another visa in their own right if they are eligible to meet the criteria.
Same for spouses of primary visa holders. Relationships can break down, the primary visa holder can inform Immigration of this, possibly risking visa cancellation for the secondary visa holder on the basis that the circumstances which permitted the grant of the visa no longer exist ie s116 (1) ….the Minister may cancel a visa if… satisfied that
(a) the decision to grant the visa was based, wholly or partly, on a particular fact or circumstance that is no longer the case or that no longer exists;
The fact which no longer exists is that the secondary visa holder spouse is no longer a member of the family unit of the primary visa holder.
A spouse in that circumstance as a secondary visa holder can go off and apply for his or her own visa like a student visa or 457 visa if he or she meets the criteria for those other visas.
